The first is the severity of the losses suffered by the grievors; the second is the inability of the CF to provide relief; and the third is the prospect of further similar grievances due to the current trends in the real estate market”(CFGBA 2011).

Relocated Military Families remain without compensation after Federal Court win

Attorney General

Tomorrow the Auditor General will be releasing their report on relocation of Canadian Forces Families. Our 4 1/2 year fight took us to the Federal Court of Canada. Our family was unfairly denied $73,000 in relocation entitlements. The government was taken to court and we won our case in Federal Court against the Attorney General (Peter MacKay). It was not the first time he was engaged on the file. Since he was the Minister of National Defence, Mr MacKay provided no assistance to our family, but rather the opposite. Now he is faced with a class action lawsuit from other CAF families.

The latest update (24 November 2014) is that the Canadian Forces was (incorrectly) waiting for the CAF Ombudsman to contact the Treasury Board Secretariat for a decision hastener.

It has been 4 months since the Federal Court directed TBS to remedy the systemic denial of Home Equity Assistance, and yet no remedy.  I would like to take the time to thank the Treasury Board Secretariat, on behalf of my family, that yet another summer has gone by without the resources to have a holiday.  Keep up the great work.

I remain committed to resolving this issue and I am  available to anyone who requires guidance, assistance or just to vent. TBS can’t hold out forever. Some day soon the TBS will be held accountable for their actions in systemically denying the Home Equity Assistance to Canadian Forces, the RCMP and their families.

The Treasury Board of Canada cannot purposefully short change families by 10’s or 100’s of thousands of dollars, and think that they can get away with it. You have chosen to pick on the wrong bunch this time.  We don’t strike, we don’t picket and we don’t loose..not ever.

Pay us your ill gotten gains TBS! You were caught in the Federal Court of Canada (https://www.canlii.org/en/ca/fct/doc/2014/2014fc488/2014fc488.pdf) and there is no hiding your negligence.

Complete findings of Soldiers Home Equity Assistance fight in Federal Court

Our sincere thanks to Justice Mosley for his decision on this matter. It is our hope that someone will carry on this fight for the remaining families who have been systemically denied the same entitlement for the same reasoning. As stated in the findings:


“TBS relied on irrelevant, post-dated and unsubstantiated information. The impression the Court is left with from the investigative file material and the memorandum is of an after the-fact justification, not a fair minded evaluation. A case was made to justify the negative conclusion previously delivered”.

I ask for Canadians to stand up for our troops in this case to advocate for the remaining soldiers who have been unjustly denied their relocation entitlements, some in excess of $100,000.

Three years searching for justice.  The journey continues.


Today, I have learned that the Judicial Review has moved to the next step.  The Crown indicates that the decision maker has no other information which was considered for the systemic denial of HEA denial (Brauer Written Reps).  I’m a little surprised that TBS is admitting that they didn’t use anything to base their decision on.
